Who We Are

Dacheng Taiwan Law Office is an independent law firm, and not a member or affiliate of Dentons. Dacheng is Dentons’ Preferred Law Firm in China, with offices in more than 50 locations throughout China. Dentons Group (a Swiss Verein) (“Dentons”) is a separate international law firm with members and affiliates in more than 160 locations around the world, including Hong Kong SAR, China. We will collect the following personal information:

  • Contact Information: Your name, position, role, company or organization, telephone number (including provided mobile phone numbers), email address, and postal address;
  • Business Information: Information that can identify you in cases where you have commissioned us or participated in;
  • Your login account and password: Used to log in to our firm's Direct Connect, external networks, and other customer service systems or platforms;
  • Information from public resources: Such as LinkedIn, similar professional networking platforms, directories, or online publications;
  • Information related to investigations or litigation: In cases where investigations or litigation are necessary;
  • Visit records: Recorded for security purposes, documenting your visits to our offices;
  • Subscriptions/Preferences: Information provided when subscribing to legal briefings, newsletters, or news bulletins, and agreeing to preference settings to indicate which information you are willing to receive;
  • Activity data: Feedback provided and participation in activities related to us;
  • Supplier data: Specific contact information left when providing services to us and other information about you, your company, or organization;
  • Social media: Interaction such as posts, likes, tweets, and other interactions with our social media;
  • Technical information: [When you visit our website and our technical services, your IP address, browser type and version (e.g., Internet Explorer, Firefox, Safari, etc.), time zone settings, types and versions of browser plugins, operating systems you are using (e.g., Vista, Windows XP, MacOS, etc.), device types, hardware models, MAC addresses, unique identifiers, and mobile network information];
  • Online data: [When you visit our website and our technical services, information about your visits, including URL clickstreams (including dates and times), information about your network, and information about devices, nodes, configurations, connection speeds, and network application performance; pages viewed or searched, page response times, download errors, visit durations, and interaction information (e.g., scrolling, clicks, mouseovers) and whether you clicked on specific links or opened our emails].

We will not collect personal information about your online activities through third-party websites or online services.

Your Communication with Us

We may also collect information you choose to provide during your communication with us. Please refrain from sending any confidential information until we have confirmed in writing that we represent you, your company, or organization. Unsolicited emails sent directly to us from non-clients do not establish an attorney-client relationship. They may not be privileged and therefore may be disclosed to others.

The Purposes for Which We Use Your Personal Data

We process your personal data for several reasons:

  • You have consented to us doing so: For example, you have shared specific information for a particular purpose;
  • To fulfill legal or regulatory obligations: For example, anti-money laundering and mandatory client screening, or disclosing information to law enforcement agencies; for legal litigation purposes;
  • For the legitimate business interests of us or third parties: Provided this does not outweigh any of your personal interests or rights.

Our legitimate business interests include:

  • Understanding and responding to inquiries and feedback from clients;
  • Understanding how clients use our services and website;
  • Identifying client needs and developing our relationship with you, your company, or organization;
  • Improving our services and products;
  • Receiving shared information from other offices;
  • Enforcing our hiring and website terms and other terms and conditions;
  • Ensuring the security of our systems and offices;
  • Managing our supply chain;
  • Developing relationships with business partners;
  • Ensuring debts are repaid;
  • Ceasing to send you marketing information if you unsubscribe;
  • Sharing data related to the acquisition and transfer of our business.

Our Use of Special Category Data

Special category data, which includes sensitive information such as your race or ethnic origin, religious beliefs, or health data, as well as information regarding criminal convictions, may be processed by us in the following circumstances:

  • We have obtained your explicit consent: consent to process specific information;
  • It is necessary to protect your vital interests or those of another person: for example, in emergency medical situations;
  • You have explicitly made the information public: for example, by posting information on social media;
  • It is necessary for the establishment, exercise, or defense of legal claims: for example, involving court litigation;
  • It is necessary for important reasons of public interest: for example, to prevent or detect unlawful activities;
  • Within the limits permitted by applicable law: both within the EU and in other jurisdictions where these limitations apply.

Who We Share Your Data With?

We share your information with the following entities:

  • Dacheng Taiwan: including their management, lawyers, employees, and contractors, to provide legal services;
  • Suppliers: units supporting our business, including IT and communication suppliers, outsourced business support, marketing and advertising agencies, backup and DR suppliers, and LPO operations. Our suppliers must meet minimum standards of information security and only receive data that is relevant to their function;
  • Shared service centers: operated by us or third parties, including customer onboarding, IT services, marketing, risk management, and office support services;
  • Other law firms: including members of the Dentons Nextlaw referral network, other local law firms, appearing counsel, expert witnesses, and arbitrators/mediators;
  • Law enforcement agencies and our regulatory bodies: or other qualified official bodies as required by law or in accordance with good conduct;
  • Appropriate parties in emergency situations: particularly to ensure the health and safety of our clients, employees, and institutions;
  • Your company or organization: in relation to the provision of legal services by us;
  • Screening service providers: to enable us to fulfill legal obligations related to the prevention or detection of crime, anti-money laundering, sanctions screening, and other necessary checks;
  • Advertising networks and analytics service providers: to display advertisements on our website, applications, and other social media tools and provide support;
  • Third parties: in the event of acquisition or transfer of any of our businesses or related business reorganization;
  • Other representatives: if you inform us of which events you plan to attend, your name will appear on the list of attendees.

Personal Data of Others

In certain circumstances, you may provide us with personal information about others (such as your clients, leaders, senior executives, shareholders, or beneficiaries). You must ensure that you have provided appropriate notice to these individuals, informing them that you have provided their information to us and have obtained their consent.

Security

We will employ physical, technical, and administrative security measures to safeguard your information. However, transmitting information over the internet is not entirely secure. While we will take reasonable steps to protect your personal information, we cannot guarantee that the information you transmit is absolutely secure, and any risks during transmission are your responsibility.

Where Will Your Information be Used?

We are a global law firm, and your information may be transferred to jurisdictions or regions outside your local jurisdiction. Data protection laws vary by country/region, and laws applicable in the United States and other regions are not identical to those applicable in the European Union or certain other jurisdictions. We will take measures to protect your information in accordance with applicable data protection requirements. For example, for those collaborating with our collaboration law firms in the EU, we have implemented Standard Contractual Clauses (SCCs) approved by the European Commission [pursuant to Article 46(2)(c) of the General Data Protection Regulation]. If you wish to obtain copies of SCCs applicable to European data, please contact us.

How Long Will We Retain Your Data?

We typically retain your information as needed to provide our legal services and handle claims. This depends on many factors, such as whether you or your company or organization are existing clients, or if you have been involved in recent client mailings or announcements, or have participated in recent events. We will retain your information in accordance with legal, accounting, or regulatory requirements. Retention periods typically range from 3 to 15 years

Your Rights

If you are working with our EU law firm or our law firm in another jurisdiction where similar rules apply, you have relevant rights regarding your information. The details of these rights and how you can exercise them are explained below.

Some of these rights apply only in specific circumstances. If you wish to exercise or discuss any of these rights, please contact the firm.

  • Access: You have the right to ask us if we are processing your data, and if we are, you can request access to your personal data. This means you will receive a copy of your personal data held by us and any other relevant information.
  • Rectification: You have the right to request us to correct any incomplete or inaccurate personal data we hold about you.
  • Erasure: In certain circumstances, you have the right to request us to delete or remove personal data. In some exceptional cases, we may refuse your deletion request, for example, if the personal data is required to be retained by law or is related to claims.
  • Restriction: You have the right to request us to suspend the processing of certain personal data about you, for example, if you want us to establish its accuracy or want to understand the reasons for processing.
  • Portability: You can have us explain how you can transfer certain personal data to another party.
  • Objection: We process your personal data based on legitimate interests (or the interests of third parties), and you can object to this. However, we may have the right to continue processing your information. You also have the right to object to us processing your personal information for direct marketing purposes.
  • Automated Decision-Making: You can object to any automated decision with legal or similarly significant effects and ask us to reconsider it.
  • Consent: We process personal data with consent, and you can withdraw your consent decision.

You also have the right to lodge a complaint with a data protection supervisory authority, especially in the EU member states where you habitually reside, where we are based, or where an alleged infringement of data protection law occurs. Right to Object

If you are working with our EU law firm or our law firm in another jurisdiction where similar rules apply, you may have the right to object to our processing of your information in certain circumstances. This applies to situations where we process your personal information based on legitimate interests (or the interests of third parties), and you can object to this. However, we may have the right to continue processing your information based on our legitimate interests or in cases related to legal claims. You also have the right to object to us processing your personal information for direct marketing purposes

Direct Marketing

As mentioned above, you can choose not to receive our direct marketing information at any time.

We may use the information you provide on our website or through other means for direct marketing purposes, including sending emails, newsletters, and other information to keep you informed about legal developments, market insights, and our services, including events that we believe may interest you.

You can opt-out of receiving our direct marketing information at any time. You can do this by changing your marketing preference settings on the online account settings page, clicking the 'unsubscribe' link at the end of any marketing email we send you, or by contacting the DPO to complete this action.
